Dig-itgames.com is committed to protecting your privacy. This Privacy Policy statement describes the personally-identifiable information governing your use of this website, any online, offline or mobile product or service to which you have access from this website, any product or service that requires a DIG-IT! Games Account to access, install or play as well as any DIG-IT! Games Account you use to access online or mobile products or services (the ” DIG-IT! Games Services “) collects and how we use and disclose it. We strive to keep our DIG-IT! Games Services relevant and interesting and we make changes all the time. This policy may change from time to time so please check back periodically to learn about our current policy. Below is information that will notify you of our specific policies for DIG-IT! Games Services. Some of the elements of our policy may relate to DIG-IT! Games Services features that we have not yet implemented.

1. What information is collected and how collected information is used

We may collect personally identifiable information, such as your name and e-mail address, when you answer our questionnaires, enter contests, fill out the registration page, purchase a product or service, send us feedback, post in our forums, chat rooms or message boards or otherwise provide such information. This information is used to fulfill your requests for products and services, for personalization services, and it allows us to contact you, such as when sending our news releases, e-newsletters, to tell you if you have won one of our contests, and other communications, to improve our services, and conduct research. Additional demographic information (like your age or profession) collected helps us to customize your experience and develop new features that are most relevant to our users. Online surveys and contests are also instances in which we may ask users for contact information (such as their e-mail address).

We also use customer contact information to send you information about our company and our products and services. You may always opt-out of receiving future such mailings from us (see the Choice/Opt Out section below). In addition, we may share your contact information only with partners and other third parties we believe can offer you goods and services that may be of interest.  We will also transfer information about you if we are acquired by or merged with another company. In this event we will notify you before information about you is transferred and becomes subject to a different privacy policy.

When you interact with DIG-IT! Games Services it allows us to learn more about you and enhance your experience with our products.  We may collect and store statistics and other information about the online activities of our visitors on an aggregated basis.  We use your IP address (which is the automatic number assigned to your computer when you surf the Web) to help diagnose problems with our servers, and otherwise administer the Site.

2. Policy for Children Under 13

Children’s privacy is of major concern to us.

We take great pride in our relationship with you. As such, we are dedicated to protecting your privacy and handling any personal information we obtain from you with care and respect. This policy for children under 13 has been shared to answer your questions regarding our privacy policies and principles with respect to children under the age of 13 (each a “child” and collectively, “children.”)

Building on our general Privacy Policy (herein), we recognize the need to provide additional privacy protections when children visit DIG-IT! Games Services on which this Children’s Privacy Policy is posted (“DIG-IT! Games Services”). We explain those additional protections here in this Children’s Privacy Policy.

The Children’s Online Privacy Protection Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age; that we obtain the consent of parents and guardians in order for children under 13 years of age to use certain features of our web sites; and that we provide parents access to their child’s personal information to review and/or have the information deleted. Below we explain how we do this for children. Also, when we use the term “parent” below, we mean to include legal guardians.

Our DIG-IT! Games Services provides two ways for children to access and use the products and services made available on, by or through our Site, including all games and learning tools (“Services”). The first is when the parent registers for the Services for use by their child(ren). The second is when a teacher registers for the Services for use by their students. When we use the term “teacher” below we mean to also include administrators of the school, district or classroom. If you are not of legal age to form a binding contract (in many jurisdictions, this age is 18), you may only use the Services and disclose information to us with your parent’s express consent. Please review this Privacy Policy and our Terms of Service Agreement with your parent.

What types of personal information do we collect about children?

In order for a child to use our Services, the parent or teacher must approve or register the child(ren)/students. By approval the parent or teacher must authorize any self-registration as part of the process. In certain cases, we also may collect a child’s e-mail address from a parent or teacher for the purpose of sending the child e-mail related to his/her registration and for customer support. Providing a child’s email is optional to support collection of results for learning management records. We may collect additional personal information from parents and teachers in order to allow the child to participate in certain features located on our Site. Educators may contact Dig-iT! Games to have an education account setup during licensing where we strictly limit any child related information.

How do we use and share the personally identifiable information we have collected about children?

Personal information regarding a child may be collected and used to enable a child’s registration for the Services, to personalize communications to a child regarding a specific game, learning tool or newsletter. Their personal information may also be used for assessment purposes in the game or learning tool and will not be shared with any third parties except for the group or school under which they registered. Some interactive activities may involve disclosure of a child’s personal information to third parties and our partners and operators. In addition, we may share a child’s personal information with third parties to the extent reasonably necessary to: protect the security of integrity of DIG-IT! Games Services; to take precautions against liability; to respond to judicial process; or to the extent permitted under provisions of law, to provide information to law enforcement agencies or for an investigation related to public safety.

Prior to disclosing any personal information regarding a child with any third party operators or service providers, we receive representations from them that their privacy policies are COPPA compliant. We periodically request re-verification of this. We never sell or use any child information collected for marketing or outreach efforts.

If you are a child who is signed up for DIG-IT! Games Services, you understand that your parent and/or teacher can view all information and activity within or associated with your account, including, without limitation, all personal information, any messages between you and your teacher and grades and assessment you receive on projects.

How do we notify and obtain consent from parents for the collection of information from their children?

We only collect personal information from a child where that child’s parent or teacher has agreed to the terms of Services via the End User License Agreement and (a) in the case of a parent, has provided consent for the child to use the Services and to provide personal information to us. To use and access our Services, the parent or teacher must first register the child. Children are not allowed to self-register or initiate the registration process or to access the Services prior to the parent’s approval of his/her account as part of the process and consent to DIG-IT! Games Services Terms and Conditions Agreement. Once the parent/teacher approves the registration process they will be able to use the Services including viewing content, playing games, using our learning tools and participating in the learning activities for which they have licensed access for.

How can parents access, change, or delete personally identifiable information about their children?

At any time a parent can refuse to permit us to collect further personal information from their child and can request that any personal information we have collected be deleted from our records.  A parent can contact our support department to access, change, or delete the personal information we have collected from his or her child by sending an e-mail to support@dig-itgames.com or through our support channel. We ask that you please include the child’s member name and the parent’s e-mail address in the requesting email so that we can better assist you with your inquiry or request.

How will you be notify parents if our Children’s Privacy Policy Changes?

We may amend our Children’s Privacy Policy at any time. We will provide parents with notice, using the e-mail currently listed as a parent email address, of any material changes in the way we intend to collect, use, and/or share children’s personal information. Please note that, at all times, parents should update their personal information to provide us current e-mail addresses. We will apply material changes in our Children’s Privacy Policy in conformance with applicable law, including any applicable provisions of COPPA policies that require parental consent.

3. Cookies and Other Tracking Methods

We may use cookies (a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a DIG-IT! Games Services computers and stored on your computer’s hard drive) to deliver content specific to your interests, to save your login ID so you don’t have to re-enter it each time you visit our site, and for other purposes to aid in your navigation and to increase the Site’s ease of use. We do not, however, use cookies to identify you personally. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set (each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences). If you reject all cookies you may not be able to use all of our products or services that require you to “sign in”, and you may not be able to take full advantage of all offerings. However, many of our products and services do not require that you accept cookies. We also track the number of people who view each page to learn which features are the most popular, but in these instances, we do not obtain personally identifiable information about you. Demographic and profile data may be used for marketing and targeting purposes. Tracking how our users interact with our site may help us to develop new features and content.

4. Public Forums

The site may, at some time, have chat rooms, forums, and/or message boards available to its users.  Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

5. Security

Unfortunately, no data transmission over the Internet can be guaranteed 100% secure. We recommend that you never reveal your IDs, logins or passwords to anyone. You will never receive a request from Dig-itgames.com for your personal information in an unsolicited phone call or e-mail. The privacy policy described here only applies to Dig-itgames.com, and not to other companies’ or organizations’ web sites to which we link, or that link to us. Also, while Dig-itgames.com hopes to provide a safe and secure online experience, be very careful about sharing your personal information with other people you might meet as a result of your visit to the Site.

In the event of a known data breach where student data is accessed or obtained by an unauthorized individual, DIG-IT! GAMES shall provide notification to registered emails related to the data breach within a reasonable amount of time of the identified incident, and not exceeding forty-eight (48) hours.  Our team will then follow our Data Breach process.

6. Opt-out

Our Site requires you to opt-in to receive certain information from us. We also provide you with the opportunity to opt-out of receiving any future communications from us. If you want to remove your information from our database and not receive future communications or registration-required service(s), please send us an email by clicking here or send a message to unsubscribe@dig-itgames.com and type “unsubscribe” in the subject line.

7. Changing/Deleting your information

You may change or modify information previously provided to us. Click here to send an email to support@dig-itgames.com, type “change my info” in the subject line and type the change in the text of the message. To remove your name from our database please send us an email by clicking here or send a message to unsubscribe@dig-itgames.com, and type “remove from database” in the subject line.
